Legal Counsel Sr.
This position will sit onsite in an Anthem office with the possibility for remote.
Responsible for providing legal advice and recommendations for initiatives and projects developed in response to clients overall objectives and needs. Focus of work is on large scale and/or high financial level projects with broad department and/or organizational impact and moderate level of risk. Works as a strategic partner and decision maker with more senior leaders, and manages work independently.
Primary duties may include, but are not limited to:
Manage all aspects of complex health-care related litigation, including provider contract disputes, ERISA and non-ERISA benefits disputes, class-actions, bid-protests and FOIA-related litigation, anti-trust issues, vendor disputes and various common-law causes of action (fraud, tortious interference, unjust enrichment, etc.); Develop strategy to be pursued in litigation; Review pleadings; Coordinate discovery responses; Communicate with internal stakeholders about risks and status; Make recommendations about handling and settlements; Determine which matters require external counsel support and assign and supervise accordingly; Active engagement in early resolution to avoid protracted litigation, where appropriate and feasible
Coordinate and supervise external litigation counsel’s handling of litigated matters;
Managing external counsel budgets; oversee expenses and review/approve invoices;
Effectively and regularly communicate with business stakeholders regarding litigation-related risks; Perform root cause analysis to identify trends and take steps to mitigate risks; Evaluate trends to determine if litigation strategies need to be refined; Follow-up, as needed, with business stakeholders to ensure identified risk minimized/deterred;
Participate on company-wide task forces or committees to provide legal/litigation input and counseling;
Support regulatory and compliance activities; Prepare witnesses for interviews with government regulators; Manage external counsel's involvement in reviewing and producing documents in connection with these activities
Requires a JD; current license to practice law; 6 years of specific industry and/or technical legal experience post licensure; or any combination of education and experience, which would provide an equivalent background.
Desired expertise is experience with medicare/medicaid
Litigation experience would be required
Bilingual in Spanish would be an asset but not required
Possibility of travel may be required.
